The regulations were a direct response to issues with substandard building practices in the past, aiming to ensure that the construction industry upholds higher standards across the board.

When Is BCAR required?

BCAR compliance is necessary for most projects, particularly:

• New buildings: Whether it’s a multi-storey office block, a public building or a family home, BCAR applies.
• Subdividing a floorplate – from single occupancy to multi-tenant use.
• Extensions or modifications: Substantial changes to existing buildings, or where there is a need for a new or amended DAC or FSC. For example, an extension of 430 sq. ft or more, or amendments to the buildings structure fall under these regulations.
• Material changes: This could be a change of use (like converting a warehouse into offices) or material alterations that affect the structure or fire safety.

There are exceptions, such as small domestic extensions or uninhabitable agricultural buildings, but it’s important to consult early to confirm whether your project needs to comply.

What does the BCAR process look like?

Navigating BCAR can seem daunting, but with the right expertise, it’s manageable. Here’s a simplified overview of the key steps:

1. Firstly the process is started by lodging a commencement notice on the BCMS, this is normally a 7-day notice.
2. Appointment of Assigned Certifier. Early in the project, an Assigned Certifier (AC) must be appointed. This individual oversees BCAR compliance throughout the construction.
3. Preparation of Documentation: The design team submits a comprehensive suite of documentation, including drawings, specifications, and certificates, to the local building control authority.
4. Inspections and Signoffs: Throughout the construction, the AC and design professionals carry out periodic inspections to ensure compliance with building regulations.
5. Completion Certification: Once the project is complete, the AC submits a Certificate of Compliance on Completion. This along with all relevant documentation and statutory approvals are uploaded onto the BCMS which then gets validated by the local building control authority.

How does BCAR impact project timelines?

BCAR introduces a new layer of oversight, which can affect project timelines. Early planning and coordination are essential to avoid delays. Submitting incomplete documentation or failing inspections may slow down the process, especially as the Certificate of Compliance is non-negotiable for project completion. However, when handled properly, BCAR can be seamlessly integrated into your project’s timeline with minimal disruption.

Something to remember is that local building control validation at the end of a project can take up to a maximum of 21 days (post BCMS upload). Until the BCAR has been validated clients cannot occupy the new space.
